YMCA Member Terms & Conditions
I, the undersigned, being over the age of majority, in consideration of being permitted to enter into or upon or to utilize the facilities, services, and the programs of the Metropolitan Young Men’s Christian Association of Huntsville (hereinafter referred to as “YMCA”), or the use thereof or participation therein by any child or children of mine, for any purpose whatsoever, including, without limitations, the participation, as a spectator or participant in any onsite or off-site program, or the use of any facilities or equipment, owned, operated, or affiliated in any manner with the YMCA, do for myself, my heirs, assigns and personal representatives, herby and with these presents forever release, waive, acquit and discharge and agree to hold strictly harmless the YMCA, its agents, servants, and employees, from and against any and all actions, causes of actions, claims, damages, suits, demands, expenses, and liability arising out of or claimed to have been incurred or sustained by the undersigned, or to or by any child or children of the undersigned, while the undersigned or such child is in, at, upon or about the premises or while engaged in any activity within the facility, or participating in any programs, or using any equipment, owned, operated, maintained, or affiliated with the YMCA. MEDICAL AUTHORIZATION In the event of an emergency, I herby authorize and give permission to any physician, hospital, or other healthcare provider as may be designated by the YMCA, in its discretion, to transport, treat, hospitalize, and provide emergency medical treatment for, and to order, authorize and administer injection(s), anesthesia or surgery for myself or minor child(ren) of mine. SWIMMING/WADING AUTHORIZATION I understand that I will be participating in swimming and wading activities in the YMCAs Aquatics Facility. I understand these activities will be carefully planned and supervised by qualified YMCA Staff and lifeguards PHOTO RELEASE I understand that my child/camper may be photographed, videotaped, and/or interviewed for the purposes of YMCA promotional use. In consideration of gaining membership and/or being allowed to participate in the activities and programs of the Heart of the Valley YMCA and to use its facilities (whether owned or leased), equipment and machinery, I do hereby waive, release and forever discharge the YMCA and its officers, agents, employees, volunteers, representatives, directors and all others from damage or injury resulting from a negligent act or omission. I understand that I should consult my physician before starting any fitness/physical program.I agree to adhere to all policies set by the YMCA as communicated to me, as posted at the YMCA facility, or as written in the YMCA Membership Handbook. In the event that I or any of my family members fail to adhere to policies set by the YMCA, I understand that my membership may be subject to suspension or termination.I understand that the YMCA requires a Change Form or Cancellation Form to be completed for me to make any changes to my membership including stopping my bank draft. Changes to YMCA accounts may take up to 15 days. The YMCA is not responsible for any bank drafts/return fees during this period. Members are responsible for paying any past due balances and return/late fees associated with the account before the membership will be deactivated. There are no refunds for memberships. I understand that the YMCA will annually review its pricing structure which may result in an increase of my monthly or annual membership fees. I understand that I will receive notice at least four weeks prior to any such change. I understand that should my contact information change (address, phone, email, etc.) it is my responsibility to update it with the YMCA. I understand that by submitting this application, I agree that the YMCA may photograph or videotape me, and the YMCA may use those photographs or video footage for its marketing purposes. I release the YMCA from any claim or liability related to that use, and waive all claims for myself, my heirs and assignee’s against the individual staff persons and the Heart of the Valley YMCA. I understand that a credit card/debit card/bank draft membership is a continuous membership which automatically renews each month. I understand that all credit card/debit card/bank draft memberships will be drafted on either the 1st or the 15th of each month. I understand that if I am signing up for electronic payment, I hereby authorize the Heart of the Valley YMCA to initiate the monthly credit or debit entries to my account indicated on this form. I understand this authorization is to remain in full force until I have completed a Termination Request. I understand there will be a $20 service charge for any bank draft returned, as well as declined credit and debit cards. I understand that the YMCA conducts regular sex offender screenings on all members, participants and registered guests. If a sex offender match occurs, the YMCA reserves the right to cancel membership, end program participation and remove visitation access. The Heart of the Valley YMCA has a “no refund” policy including registration fees and deposits, which are non-refundable. I understand that electronics devices, including cell phones are not allowed in any child care program. They will be locked up and returned to parent at pick up time. The only exception will be school issued laptops to be used during scheduled times for homework purposes. Membership Cancellations Members who pay their monthly dues through a monthly automatic withdrawal must give written notice by the 25th of the month to cancel membership effective in the following month.
